Bankruptcy and Restructuring

Northen Blue is one of the premier bankruptcy and insolvency firms in the state of North Carolina, helping businesses and individuals navigate complex financial circumstances. We offer experienced, strategic and cost-effective counsel to debtors, creditors, guarantors, trustees, and other parties in connection with all aspects of bankruptcy and insolvency cases, including:

Chapter 11 Bankruptcy and Negotiated Workouts

We have experience representing businesses across a wide range of industries, including retailers, manufacturers, construction companies, real estate developers, petroleum suppliers, assisted living facilities, golf courses and various service businesses. We have represented companies with total assets and liabilities in excess of $100 million, as well as much smaller businesses.

Creditor Representation

We represent creditor committees and individual creditors such as non-institutional lenders, private equity firms, trade creditors, and landlords. To avoid potential conflicts of interest, Northen Blue does not represent banks or other large commercial lenders.

Individual Bankruptcies

Our firm is well-versed in representing individuals in Chapter 7, Chapter 13, and Chapter 11 bankruptcy cases, as well as helping individuals negotiate their liabilities outside of bankruptcy.

Guaranty Defense

We help business owners that have signed personal guarantees defend against collection activities and preserve their personal assets.

Distressed Acquisitions

We represent buyers and sellers in acquisitions of businesses and distressed assets in the context of bankruptcy cases or out-of-court workouts.

Bankruptcy and Insolvency Litigation

We have represented clients in hundreds of adversary proceedings in bankruptcy court, including routine preference and fraudulent transfer actions, complex commercial litigation arising in U.S. Bankruptcy Court or Federal District Court, and appeals taken to the Fourth Circuit Court of Appeals.

Trustee and Receivership

We represent trustees and receivers in connection with the performance of their duties, and litigation brought on their behalf.  John Northen has served as chapter 11 trustee in complex cases, as well as a state court appointed receiver. Vicki Parrott has frequently represented trustees in chapter 11 and chapter 7 bankruptcy cases, as well as state court appointed receivers.
